A bill, AB 1014, is speeding through the committee process in the California State legislature, en route to what, if it passes, will be a direct conflict with the United States Constitution.
The bill empowers relatives, policing authorities and licensed health care professionals to seek restraining orders against any individual they feel is a potential threat, whether there is a proven legitimate basis for that determination or not. A hearing is conducted after the confiscation takes place to determine if and when the property is returned.
It also provides, upon a judgeâ€™s order, for a search of oneâ€™s residence, without prior knowledge or consent.
The potential for abuse is boundless, with this legislation being a big slide down the slippery slope of totalitarian control, the type of thing that our Constitution is designed to guard against. In this case, the Constitution is as much the target as any perceived threatening gun owner.
The abuse could even go beyond firearms, with anything unlawful observed or claimed during the search becoming legitimate evidence for other charges and prosecutions; this would be a wide open door for tyranny to walk through, based merely upon hearsay.
Citizens effectively face sanctions by the government for a crime they did not commit, based upon the opinion of someone who may or may not have good intentions and who may or may not be qualified or objective in their evaluation.
