Constitutional Attorney – States Have The Legal Authority To Defend Border Under Constitution


A solution to our border crisis which the federal government is creating does exist, and the mechanisms for implementation exist as well. Constitutional attorney Michael Connolly offers it for our consideration below:

Since I live in Texas, I am painfully aware of what is happening on the Texas border with Mexico and on the borders of Arizona, New Mexico and California. Thousands of children from El Salvador, Guatemala, and Honduras are crossing the border every week. Many of them are teenagers with known affiliations to violent gangs such as MS-13. They are not being detained to be deported, but in many cases being sent to American cities where the gang is active.

Many children and adults that are being literally bused into our country illegally are also ill with the dangerous swine flu, tuberculosis, and chicken pox among other diseases. Some are being treated at U.S. taxpayer expense, but most of the illegals are not even getting basic medical exams before being placed in our military bases or sent to facilities in cities and towns around the country. We are looking at a far reaching and potentially deadly medical crisis.

None of this seems to really interest Obama, probably because his policies, including refusing to enforce immigration laws and issuing executive orders to institute the so called “Dream Act” that Congress refused to pass, are the cause of this crisis. All of that violates Article 2, section 3 of the constitution that requires the President “to take care that the Laws be faithfully executed…” Clearly, Obama has no intention of fulfilling his oath of office and obeying the Constitution.

In addition, another major concern being ignored by Obama is the known fact that criminals and potential Islamic terrorists from Yemen, Iran, Somalia, and other Middle Eastern and African countries are using the open border as an opportunity to enter the U.S. and set up shop. High ranking military and Intelligence officials fear terrorist attacks within the U.S. are imminent.

However, Obama has no time during his visit to Texas to go to the border and see the crisis for himself. He is doing the one thing that really interests him, fund raising for Democrats for the upcoming election. Citizens of Texas and other border states are demanding that something be done and so Obama proposes spending billions of dollars to house, feed, clothe, educate, and otherwise care for people who are knowingly and wantonly violating our laws.

There is a way to stop this invasion and it is contained in our Constitution. The states can take action on their own in a manner that would protect our borders and strike at the heart of the Obama administration and its unconstitutional policies. Article 1, Section 10 of the Constitution states in paragraph 3:

“No state shall, without the consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in times of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.” (Emphasis added)

We are being invaded and not just by innocent children as the leftist media would have you believe. We are being invaded by criminals and terrorists from numerous foreign nations. American lives and property are in danger as are the economies of many states, not just those on the border.

Therefore, I am calling on the governors of Texas, New Mexico, Arizona, and California to exercise the power and authority granted to them by Article 1, section 10 of the U.S. Constitution and use whatever resources are necessary, including the National Guard, to seal our southern border. It will not be cheap, but it will certainly ultimately cost less than having hundreds of thousands of additional illegals come in and overwhelm the state economies.

Everyone who lives in these states needs to contact their governor and state representatives to encourage this action. People in other states should contact their elected officials to get them to support any such actions taken by these four states. Otherwise, disaster is imminent.

One other point that could be valuable in implementing this strategy would be if it is possible for states to share resources, for a non-border state to “loan” their national guardsmen to another state and to share expenses. It would seem that, in view of the crisis, to quote B. Hussein Obama, to be more than appropriate take legal action and then let him sue us, if his socialist ideals are infringed upon.

  1. I’m a 20 year old United States born citizen of this great country America. My father was raised in Houston, Texas, had a job by the time he was 14, and had his own place by the time he was 17. Why am I telling you this, you may wonder…well my point to just that sentence is that how many 17 year olds even work now? A very small percentage. These illegal immigrants not only disgrace to our beautiful country but they also parasitically poison America and the American citizens. Drugs and gangsters come through the borders all day and all night, which complies to your young children doing drugs, flunking school, getting violated, raped, and sometimes murdered. Now everyone knows that it’s impossible to get rid of these drugs and gangs BUT we can prevent more drugs being brought into our country and maybe prevent more children from dying by stopping this bull shit. Now I sit here and read about this bull shit all day long and never see our hear about anyone doing anything. I’m 20 years old with no job, no car, and every year… less friends. Do to this infection in our country. Like most viruses, there must be a vaccine, a way to fight back. WE THE PEOPLE of this great nation must follow our laws and amendments but I consider this to be a alien invasion and let’s say aliens from outer space came here tomorrow and started slowly destroying our planet, would the laws then apply? I think NOT! Then why do we the REAL American people not stand up for this? They call us racist for hating this that it’s killing our country slowly? For sticking up for this once amazing country? This country can be great if we stop worrying about what the fuck everyone else is doing. Our problems are not across the borders or overseas, there here in the heartland of this country and until we stop worrying about bull shit, we will sit here and watch our countries sickness grow.
    I’m going to speak for my generation and say that we need new H.O.R., senators, and just like millions of people have already said, a new president who is actually a citizen of the USA.

    ….I have no job. I’ve been homless twice. I’m 20 years old. I graduated high school and I know that our great forefathers are looking down on us from the heavens with shame. It’s time for a change people, I’m tired of going hungry, I’m tired of not having a bed to sleep on. I’m tired of waking up every morning worrying if I’ll have food to eat for the day. Houston, Texas has 75% Latino I don’t care what the internet says, come visit and you’ll believe me. Anyway, out of that 75% only 10% speak English. (This is my personal opinion) those 65% that don’t all have American jobs, why? Because of our excuse for a government.
    Let me ask y’all something. Have you ever in your lifetime ever seen a homeless Latino or Asian etc? No?! Neither have I.
    It’s a fucking embarrassment that I personally wish I lived in the past here in America. I would rather give up all technology and medicines and discoveries then live in this lifetime.
