Report: Maryland State Attorney Had It Wrong. Freddie Gray’s Knife Was Illegal


After Marilyn Mosby, the Maryland State Attorney who, as Jazz Shaw put it, took a tiger by the tail last Friday and overcharged six Baltimore city police on charges related to the death of Freddie Gray, it was inevitable the police themselves would strike back.

Buried in a Baltimore Sun piece on gunshots at the scene of the protests on Monday was information that contradicts Mosby’s assertion that the knife found in Freddie Gray’s possession at the time of his arrest was a legal blade and therefore the arrest was invalid.

Meanwhile, a police investigation continues as Baltimore State’s Attorney Marilyn J. Mosby builds her case. The separate investigations by police and prosecutors have some conflicting findings.

While Mosby said Friday that the officers had made an illegal arrest because a knife Gray was carrying was not a “switchblade,” a violation of state law, the police task force studied the knife and determined it was “spring-assisted,” which does violate a Baltimore code.

Oops.  It looks like the investigations aren’t talking to each other.

Until the knife is produced as evidence either at trial or some other court appearance, the public may not know for sure.  Until then, it looks like the Maryland State Attorney tried to pull a fast one while not even reviewing all the evidence.

If the knife in question was illegal, as the police task force claims, then Mrs. Mosby owes those charged with making an illegal arrest an apology.
